Group Compensation Claim

Holiday Clubs

The Timeshare Consumers Association and London law firm  Hausfeld & Co LLP   ("Hausfeld") are working together to claim compensation on behalf of purchasers who allege they have been mis-sold membership of a holiday club.  FRA Solutions Ltd  ("FRA") is responsible for gathering data and information from potential claimants in support of their claims.

Any holiday club purchase involving a payment by credit card is governed by the  Consumer Credit Act 1974  ("the Act"). The Act allows a claimant, who can prove a valid claim, to seek a remedy from the credit card provider as well as the seller.

Hausfeld intend to bring a claim against the credit card companies to recover compensation on behalf of holiday club claimants who allege misrepresentation and/or breach of contract (whether they purchased their holiday club in the UK or abroad).

The claim will seek to refund those who lost out with the whole amount they paid, not just the credit card payment, provided the total payment was less than £30,000.

Hausfeld are working on a conditional fee basis so claimants will not incur any costs in joining the group. If litigation commences Hausfeld will seek to arrange insurance against costs, to protect claimants from having to pay the lender's legal costs in the unlikely event the claim does not succeed. This provides holiday club consumers with a virtually risk free process’. Likewise TCA do not make any charge.
